Permission to buy farmland

Section 63 makes a sale, gift, exchange, lease or mortgage of agricultural land INVALID in favour of a person who is not an agriculturist. A non-agriculturist buyer must get the Collector's prior permission or the transaction is void.

The form you fill in

iORA service 17: 'ગણોતધારાની કલમ-૬૩ મુજબ ખેતીની જમીન ખરીદવા બાબતની પરવાનગી મેળવવાની અરજી'. Parallel services exist for Saurashtra Gharkhed Act section 54 (row 18) and Bombay Tenancy (Vidarbha Region and Kutch Area) Act 1958 section 89 (row 19). A farmer applicant can first obtain the khedut khatedar verification certificate via iORA service 20.

The same section carries a further proviso that permission shall NOT be granted where agricultural land is sold to a non-agriculturist for agricultural purpose if that person's annual income from other sources exceeds five thousand rupees. Section 63(1A) allows the State Government to exempt, by notification, transfers to a non-profit public charitable trust for health and education use.
